Sedona couple ordered to pay for racial comment

PHOENIX - The Attorney General's Office announced the settlement of a case Tuesday stemming from a lawsuit alleging that a Sedona couple refused to sell property to a California couple because of race.

In April 2004, Phillip and Kristina Edington of Stockton, Calif., made a full-price offer for a residential lot in Sedona. The lot is owned by Feliks and Bozena Mlynarczyk and is adjacent to their Sedona home, according to the Attorney General's Office.

Court documents state that Mlynarczyk rejected the offer and told the couple he would not sell to "Black people." The couple's real estate agent reported the comments to the Attorney General's Office.

Under the terms of the settlement, the Mlynarczyks will pay $120,000 to the Edingtons for damages, $25,000 to Buyer Brokers Realty of Sedona and $40,000 to the state, according to a news release.
