AG's Office won't pursue criminal complaint against mayor
MESA, Ariz. (AP) -- The Arizona Attorney General's Office has decided Carefree Mayor Ed Morgan didn't violate public records laws after he used the town's e-mail distribution list, stationery and postage in response to a political attack.
The attack came in August when Carefree activist Jim Pierce had written an insert in a local newspaper listing the top 10 reasons Morgan should resign.
The mayor responded by writing letters and e-mails to town residents and about 25 homeowners associations.
Pierce later filed a criminal complaint with the attorney general, accusing Morgan of violating public records laws.
Assistant Attorney General Theodore Campagnolo told Pierce the office would not be pursuing the matter.
"In order for this office to institute criminal proceedings, we must believe that there is a reasonable likelihood that a defendant will be convicted beyond a reasonable doubt," Campagnolo said. "That is a heavy burden for the state, and one that cannot be met under the facts presented."
